Terms and conditions for use of Games Pack

These terms, together with your Price Plan terms and conditions ("Terms and Conditions") are the Terms which apply to your use of the Games Pack (“the Service”). If you don’t agree with them then please don’t use the Service.

What is the Games Pack?

The Games Pack lets you download games straight to your mobile. As long as you are subscribed there is no limit to the number of Games which you can download (subject to handset storage capacity). The Games Pack can be included as part of your tariff or you can sign up on a month to month basis.

Cost

The price of the Games Pack will be the price advertised to you at the time of purchase. If we change the price of the Games Pack we will give you at least one month’s notice of the change. The new price will then be applied automatically so if you no longer want to have the Games Pack you must tell us (see the “Ending the Service” section below).

The Service is for use in the UK only. There are no data charges for browsing or downloading games while you are in the UK. If you access the service outside the UK then you may incur browsing, downloading and other data charges at the standard data rates for roaming.

The cost of the Games Pack will be charged to your pay monthly bill or deducted from your pay as you go credit.

Ending the Service

If the Games Pack is included as part of your tariff then it is subject to your fixed term agreement and you can cancel it only in accordance with your Price Plan.

If you have the Games Pack as a monthly subscription then you can cancel it by calling 191, through the My Account pages on the EA service or by visiting a Vodafone store. Once you notify us that you wish to cancel, the termination will take effect from the next date on which your subscription payment would have been due. No refund will be provided for payments made prior to the date that termination takes effect.

What else should I know?

The Service is subject to availability, network coverage and handset capability and is for your personal, non commercial use only.

Once you remove the Games Pack you will no longer be able to play any of the games that you have downloaded as part of the Service. If you change your mobile then you can continue to use the Games Pack on your new mobile as long as it is also compatible with the Service.

In using the Games Pack Service, you must comply with all applicable laws. Any redistribution, transmission, sale, broadcast, public performance, rental or lending, adaptation, sub-licence or other use of the Games content provided through the Games Pack Service is expressly prohibited without the prior written consent of the copyright owner. Vodafone may change or remove individual Games at any time and may limit access the Games Pack Service from time to time for maintenance purposes.

Vodafone or its licensors grant you a non-exclusive licence to download and use the Games on your mobile device only. All rights including intellectual property rights in the service and the Games remain the property of Vodafone and its licensors. You may not copy, distribute, unzip, reverse engineer, decompile or otherwise disassemble the Games or use any of its constituent elements in any way. The use of the Games may also be subject to the licensor’s end user terms and conditions.

Fair usage: The Service is subject to a fair use policy. If, in Vodafone’s reasonable opinion your use is excessive, we may ask you to moderate your usage. If after we have informed you to moderate your usage, you fail to do so, we may charge you for the excessive element of your usage at your price plan's standard rate or we may suspend or terminate your access to the Service.

Except as otherwise expressly stated in these Terms and Conditions or as permitted by law, your sole remedy for any faults with the Games is a refund of the subscription price paid.

This Agreement is under English law, unless (i) you live in Scotland, in which case, it will be governed by Scots law, or (ii) you live in Northern Ireland, in which case it will be governed by the laws of Northern Ireland.
